The deadline to apply for building regularization under Law No. 17.202/2019, known as the Amnesty (Anistia), ends on November 30, 2026. The date was set by Decree No. 65.481 of August 28, 2026, which extended the previous deadline of August 30.

The law applies to buildings completed by July 31, 2014 that do not comply with the legislation, such as the Building Code and the Zoning Law. For the law, a building is complete when the walls are up and the roof is in place.

The law's three paths

The law provides for three procedures. In the automatic one, low- and middle-standard homes that had full IPTU exemption in 2014 are considered regular, with no application. In the declaratory one, for buildings of up to 1,500 m² in the cases provided for, the application is electronic, with documentation signed by a licensed professional. In the standard one, for all others, City Hall carries out the full technical review.

What usually delays the application

When justifying the extensions, City Hall cited the time needed to obtain documents from the registry office and prepare plans and technical reports. So anyone planning to apply should now gather the updated property record (matrícula), the IPTU and information about what was built, and commission the technical items.

Once the regularization document is issued, the built area can be recorded on the property record (matrícula) at the Property Registry Office (Cartório de Registro de Imóveis). It is this recording (averbação) that makes the property record show the complete property.

The last two extensions came out a few days before the end of the deadline. There is no guarantee there will be another: the deadline that applies today is November 30, 2026.

What this changes for you

  • If the property has more area than the approved plan and was completed by July 2014, check now whether it is eligible.
  • Gather the updated property record, the IPTU and photos; technical items signed by a professional take time.
  • Do not count on a new extension: the deadline that applies today is November 30, 2026.
